1. Definitions and Interpretation
1.1 “Company” means MCR Pools & Spas Ltd, registered in England and Wales, with Director Nathan Keziah.
1.2 “Customer” means any individual or entity subscribing to the Company’s swimming pool servicing plans.
1.3 “Subscription Fee” means the monthly fee payable by the Customer for the chosen service plan, plus any applicable VAT.
1.4 “Service” refers to the routine pool servicing and cleaning provided as per the selected plan, as well as any technical checks and water treatment.
1.5 “Weekly Plan,” “Bi-Weekly Plan,” and “Monthly Plan” refer to the respective servicing options detailed below.2. Service Plans and Payment Terms
2.1 Plan Options:
(a) Weekly Plan: £480 + VAT per calendar month, providing one pool service per week (typically 1–2 hours per visit).
(b) Bi-Weekly Plan: £360 + VAT per calendar month, providing one service every two weeks (approximately 2 hours per visit).
(c) Monthly Plan: £250 + VAT per calendar month, providing one service per month (typically 2–3 hours per visit).
2.2 Payment is due in advance each month via the Customer’s nominated payment method. 2.3 The Subscription Fee is subject to VAT at the prevailing rate.3. Description of the Service
3.1 The Service includes:
- Water chemistry and treatment
- Cleaning, including vacuuming and skimming when required
- Cleaning of pool tiles and waterline
- Cleaning out skimmer baskets
- Checking filter media and performing backwashing
- Technical checks to ensure pool equipment and functions are operating optimally
3.2 Exclusions:
- Parts, extra labour required and chemicals required for water treatment are not included in the Subscription Fee and will be invoiced separately.
3.3 Additional Charges:
- In the event the pool is excessively soiled or requires repairs beyond routine servicing, additional charges may be incurred for extra time, services, or parts.4. Early Service Requests
4.1 Should the Customer wish to receive their scheduled service earlier than the designated service date, the Customer must settle any outstanding balance required to cover the full value of that service period before the service is rendered.5. Cancellation of Scheduled Service Dates
5.1 If the Customer cancels or fails to be available for a scheduled service date, it is the Customer’s responsibility to rearrange a new service date.
5.2 The Company will not be liable for missed service dates or subsequent rescheduling.6. Non-Refundability
6.1 All Subscription Fees paid are non-refundable.
6.2 If the Customer does not use the services provided, no refund shall be issued.7. Cancellation of the Subscription
7.1 The Customer may cancel the subscription at any time by providing written notice to the Company.
7.2 Cancellation will affect future billing only; no refunds will be provided for Subscription Fees already paid.
7.3 The Customer is responsible for ensuring that cancellation is communicated in accordance with the process outlined by the Company.8. Liability and Service Quality
8.1 The Company will provide the Service with reasonable care and skill.
8.2 The Company’s liability for any claim arising out of the provision of the Service shall be limited to the total Subscription Fees paid by the Customer in the preceding 12 months.
8.3 Nothing in these Terms limits the Customer’s statutory rights under applicable UK consumer protection legislation.9. Governing Law and Jurisdiction
9.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
9.2 Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.10. Amendments
10.1 The Company reserves the right to amend these Terms and Conditions upon providing 30 days’ notice to the Customer.
10.2 Continued use of the service following any such notice constitutes acceptance of the amended Terms.11. Contact Information
